In order to quit the tobacco habit, people are adapting to electronic cigarettes, which are also known as Vaping. However, it turns out this is not a good time to become a vaper as the state government enforced restrictions on Vape buying and selling to help the FDA crackdown the people who distribute vape illegally.
Transportation issues
In 2009, PACT Act implicit a law which restricted the USA Postal Office to drop shipping any tobacco related products directly to the customers. In 2020, Congress applied new restrictions to this law on how USPS should ship tobacco and included vape products (with nicotine and without nicotine) under this. So, it’s not easy for vape distributors to ship the products.
Following these rules, private shipping organizations like UPS and FedEx planned to imply a few rules. FedEx decided not to ship any tobacco products. They imply this rule not only for individuals but also for shops despite their license and authorization.
UPS listed out more specified rules than FedEx, saying they will not deliver any tobacco and vape products, even its non-nicotine. In addition, they ban both import and export for these products.
Last year, the US e-cigarette and vape market possessed a $6.09 billion value. Because both the buyers and sellers made transactions through the internet amending federal laws and tax collection. So, if anyone violates the law, they have to face criminal penalties.
The FDA’s enforcement efforts
FDA never stopped their progress in repressing the vape shops despite the political changes in the State. Even this year, many manufacturers received warnings from the Centre for tobacco products. These warnings are for adding up any unknown or secret ingredient and not revealing the truthful nature of the product. In short FDA defines: adulterated and misbranded. Because these products do not have FDA’s authorization.
The FDA derives regulations for tobacco products based on the 2009 Tobacco control and Federal Food, Cosmetic and Drug Acts. According to that, vape products also come under the tobacco category.
Local Government Initiatives
After these changes in laws, local governments are planning to impose few laws to reduce smoking. Florida and Tennessee are increasing the vaping age to 21. New York and Suffolk County are going one step ahead, increasing to 25. Nebraska recently banned indoor vaping, and Indiana is planning on a flavor ban.

The FDA didn’t say anything about vaping safety. Consumers have to be sure of what sources they are using, especially in the fast-growing market. Tobacco users must analyze the ingredients and their safety before using them.
